Another lawsuit challenging the use of red light cameras was tossed out of court last week, this time in Arnold. The City of Arnold and the company who operates these devices, American Traffic Solutions, had their request granted to throw out the class action lawsuit. The Simon Law Firm is already working on an appeal of this case, as well as other similar red light camera cases in Creve Coeur and Kansas City. Indeed, as the judge in this case stated in his opinion, “this court’s decision is by no means the last word on these issues.” While this may be true, an alarming amount of these cases are being thrown out without much litigation. An attorney representing the plaintiff in this case has said that the ultimate goal is sending a red light camera case to the Missouri Supreme Court. This appears to be years away from happening, so in the meantime, watch out for these cameras, and remember, if you get a red light camera, 97% of the time it’s best to simply pay them rather than put them off.
